HOSTING CONTRACT
1. OBJECT.
By virtue of this contract, the company IRREAL TURISMO E INVERSIONES SPA, owner of the commercial name HOSTAL IRREAL, From now on, the HOSTEL will provide accommodation to the GUEST in the room and its accessories., in exchange for a price, by the number of days reserved and paid, indicated on the Registration Sheet . In no case may the term be greater than 30 consecutive days. 1.1.- The room will be the one indicated on the REGISTRATION SHEET that will be issued upon check-in.. . The HOSTEL may make a room change if the guest accepts it and it is a room of equal or better conditions., or in the event of a fortuitous event or force majeure. 1.2.- The time of entry or check in is from 14:00 (2 pm) on the day of arrival and the departure or check out time is until 12:00 (12 noon) on the day of departure. The period of time between one hour and another corresponds to the hotel day. Early entry or departure after the indicated time will be subject to availability and the GUEST must pay the corresponding amount.. 1.3.- Accommodation will be provided regardless of the time the GUEST actually stays in the room.. Partial use causes payment of the full rate. 1.4.- The provision of the services object of the contract and those complementary services offered by the hotel will be subject to availability and schedules., shifts or physical stocks of inputs, estate, facilities or spaces for it.
2. PRECIO.
2.1.- The price corresponds to the fee per night that the GUEST is obliged to pay and which amounts to the sum indicated on the Registration Sheet corresponding to the reservation made., all of which will be described on the corresponding invoice, unless the reservation has been made and paid through a travel agency or internet platform, in which case the rate will be the one that has been agreed directly with the agency or operating platform. 2.2.- The GUEST must pay in advance for its use or consumption, all food charges, drinks, laundry and in general for all those services not included in the reservation and that are generated during your stay. 2.3 The room and the price or rate per night will be the one agreed upon in the reservation and indicated on the corresponding Registration Sheet. 2.4.- The GUEST declares that he has been informed of the rates, fees and in general room prices per night.
3. MONEY CUSTODY, OBJECTS AND LUGGAGE
The hostel does not provide custody service. We recommend that you keep your room locked and store all objects in the corresponding lockers and padlocked., which must be provided by the GUEST or purchased at check-in. Exceptionally and informally, certain objects or luggage, they will be able to protect themselves, temporarily, remaining under the sole risk of the GUEST since in case of loss or deterioration, THE HOSTEL does not assume any responsibility, because it is not an official or paid service.

4.- OBLIGATIONS.
4.1.- FROM THE HOSTEL.
4.1.1.- Provide the service that is the object of the contract. 4.1.2.- To meet, receive, process and respond to suggestions, complaints or claims submitted by the guest. 4.1.3.- The others established under your responsibility in the Law.
4.2.- FROM THE GUEST.
4.2.1.- Identify yourself to register at the HOSTEL with a suitable identification document, presenting your identity card if you are Chilean or your passport or applicable document in the case of foreigners. For minors, Valid identification document must be presented. 4.2.2.- Pay the value of the accommodation plus the corresponding taxes. 4.2.3.- Pay the value of all consumption and charges that you have made to your account. 4.2.4.- Observe decent conduct and dress appropriately. 4.2.5.- Respond even to slight fault for your obligations and those of your companions or guests. 4.2.6.- Register all the GUEST's companions or guests at the hotel reception and pay the fee or value if applicable, for each of them. 4.2.7.- Respect the number of people per room. 4.2.8.- THE GUEST acknowledges that the use of instruments, tools or utensils of common use and in general any activity that represents a risk or danger, it will be your decision, under their exclusive responsibility and implies that the GUEST has the skills and knowledge that allows them to assume said risks., exonerating the HOSTEL and its officials or employees from any responsibility in the event that you suffer any damage or injury. 4.2.9.- Use the furniture, equipment, equipment and in general the facilities of both the room and the HOSTEL, in an appropriate manner, preserving them in the state in which they are found and therefore will be responsible for any damage or loss of the elements and property of the HOSTAL., even for slight guilt. In case of total or partial loss or damage to the HOSTEL property due to a cause attributable to the GUEST or their companions., The GUEST must pay the price corresponding to its repair or replacement, depending on the case. 4.2.10.- Respect the authority of the HOSTEL Manager. 4.2.11.- Allow the right of inspection and/or surveillance of the room by HOSTEL officials. This right will be exercised in a reasonable manner and includes the power to enter or search the room when in the opinion of the HOSTEL Manager it is necessary.. 4.2.12.- Allow HOSTEL employees and officials access for routine work and room cleaning.
5. TERMINACIÓN DEL CONTRATO.
El contrato de hospedaje terminará en los siguientes eventos: 5.1- Por vencimiento del plazo pactado. 5.2.- For non-compliance with any of the obligations of the parties and specifically for non-payment of the price or fee payable by the GUEST or for non-payment of food and beverages or other complementary services.. 5.3.- In events where, at the exclusive discretion of the HOSTEL, the behavior or state of the GUEST threatens the tranquility and/or health of other guests or visitors. 5.4.- For smoking in the room or in any other smoke-free space in the hotel, when other guests are affected, visitors or users and without prejudice to the payment that must be made in the terms established below. Paragraph: The termination of the contract does not exonerate or release the GUEST from payment of outstanding balances..
6. EFFECTS OF TERMINATION.
6.1.- At the end of the contract, the HOSTEL will be able to freely dispose of the room.. 6.2.- Upon termination of the contract and regardless of the cause of termination, the HOSTEL is authorized to enter the room, prepare and sign an inventory of the guest's effects and luggage and remove them from the room to leave them in a safe and adequate deposit, without responsibility of the HOSTEL and at the expense and risk of the GUEST. 6.3.- If the GUEST will not pay the bill or part of it, The HOSTEL may dispose of and sell the GUEST's luggage and objects to cover pending obligations with its proceeds.. The surplus if any, will be made available to the GUEST. In case of deficit, The HOSTEL may initiate the corresponding actions to obtain full payment of the amount owed..
7. SEVERAL.
7.1.- Legal nature of the contract. The accommodation contract is a rental contract, of a commercial and accession nature. 7.2.- The lodging contract is proven by the Hotel Registration Sheet that the HOSTEL issues., accepted by the signature of the GUEST, which states that it adheres to the stipulations contemplated here. THE GUEST expressly accepts that the liquid sum of money stated on the invoice, will provide executive merit.7.3.- The HOSTEL rejects and does not allow sexual exploitation or any form of sexual abuse. The HOSTEL rejects and does not allow sexual tourism nor does it allow the sexual exploitation or abuse of girls., children or adolescents. The GUEST will not be able to enter their room under the age of eighteen. (18) years of age for sexual tourism and whoever does it may be reported to the competent authority. 7.4.- Charges for smoking in rooms. Being consistent with the care of the environment and health, all rooms and in general all areas of the hotel are smoke-free. Smoking in the room or in any other space of the hotel constitutes a serious breach of the accommodation contract that gives rise to its termination and may be removed from the HOSTEL if it has affected other guests., visitors or users. If the GUEST smokes in the room, bathroom or any other area where it is not allowed, he/she must pay the cost that the HOSTEL must incur to deodorize and clean the room., equivalent to 10.000 weights or 12 USD and the value of (1) night at the rate corresponding to your accommodation, since the room cannot be used during 24 horas. 7.5.- The HOSTEL rejects any form of discrimination, distinction, exclusion, restriction or preference based on gender, raza, color, national or ethnic origin, religion, political opinion or for any other reason or condition that has the purpose or that

produces the effect of deteriorating, restrict or limit the full enjoyment of fundamental rights and freedoms.
8. NOTICE OF PRIVACY.
AUTHORIZATION USE OF DATA AND INFORMATION.
By signing this contract the GUEST expressly authorizes the company IRREAL TURISMO E INVERSIONES SPA, con NIF 77269162-9, in her capacity as HOSTEL operator, to collect and use the information and personal data provided by the GUEST in the Registration Sheet such as name, address, ID, nacionalidad, birthdate, Email address, landline and mobile or cell phone number, personal preferences and interests, work or activity, in accordance with the secure information processing policies established by the Hotel itself and by current laws for the purpose of carrying out loyalty activities and contacting the owner of the information to send service surveys after each stay that allow the rating of the service provided, and communicate the invitations, offers, promotions, portfolio of services or general information that is aimed at continuing to use the Hostel and offering the corresponding services. The GUEST authorizes the information to be transferred, transmitted, shared and provided, exclusively for the purposes described above.
The GUEST, as the owner of personal data, will have the right at all times to know, to access, update and rectify your personal data, revoke the authorization granted or request the deletion of information when appropriate.
